This paper examines the efforts of contractualists to develop an alternative to aggregation to govern our duty not to harm (duty to rescue) others. I conclude that many of the moral principles articulated in the literature seem to reduce to aggregation by a different name. Those that do not are viable only as long as they are limited to a handful of oddball cases at the margins of social life. If extended to run-of-the-mill conduct that accounts for virtually all unintended (...) (in the sense of undesired) harm to others—noncriminal activities that impose some risk of harm on others—they would rule out all action. Moreover, because such conduct poses an irreducible conflict between freedom of action and freedom from expected harm, it can be regulated only by principles that accept the necessity of making precisely the sorts of interpersonal trade-offs that contractualism is foundationally committed to reject: trade-offs in which the numbers count, such that a risk of serious harm to one person can be justified by small benefits to the many. Despite the rekindling of an often bitter debate as to the meaning of Martin Heidegger’s involvement with National Socialism, little has been done to address afresh the texts themselves of the period in question and the problematic to which Heidegger conceived he was applying himself. Defying Enlightenment universalism, Heidegger asserts that meaningful human existence requires a belonging in a particular historical community whose integrity must be sustained in what he calls “Auseinandersetzung,”---confrontation. This paper attempts to show how “Auseinandersetzung,” itself Heidegger’s (...) translation of the Greek word “polemos,” underlies central concepts of Heidegger”s ontology, influencing his views on work, art, and great creators. Contract as Promise is a study of the philosophical foundations of contract law in which Professor Fried effectively answers some of the most common assumptions about contract law and strongly proposes a moral basis for it while defending the classical theory of contract. This book provides two purposes regarding the complex legal institution of the contract. The first is the theoretical purpose to demonstrate how contract law can be traced to and is determined by a small number of basic (...) moral principles. Modern scholarship has drawn hasty and numerous parallels between the Yellow Peril discourses of the 19th- and 20th-century plagues and the recent racialization of infectious disease in the 21st-century. While highlighting these similarities is politically useful against Sinophobic epidemic narratives, Michel Foucault argues that truly understanding the past’s continuity in the present requires a more rigorous genealogical approach. Employing this premise in a comparative analysis, this work demonstrates a critical discontinuity in the epidemic imaginary that framed the Chinese as pathogenic. (...) Major depression (MD) is a highly heterogeneous diagnostic category. Diverse symptoms such as sad mood, anhedonia, and fatigue are routinely added to an unweighted sum-score, and cutoffs are used to distinguish between depressed participants and healthy controls. Researchers then investigate outcome variables like MD risk factors, biomarkers, and treatment response in such samples. These practices presuppose that (1) depression is a discrete condition, and that (2) symptoms are interchangeable indicators of this latent disorder. Here I review these two assumptions, elucidate (...) their historical roots, show how deeply engrained they are in psychological and psychiatric research, and document that they contrast with evidence. Depression is not a consistent syndrome with clearly demarcated boundaries, and depression symptoms are not interchangeable indicators of an underlying disorder. Current research practices lump individuals with very different problems into one category, which has contributed to the remarkably slow progress in key research domains such as the development of efficacious antidepressants or the identification of biomarkers for depression. The recently proposed network framework offers an alternative to the problematic assumptions. MD is not understood as a distinct condition, but as heterogeneous symptom cluster that substantially overlaps with other syndromes such as anxiety disorders. MD is not framed as an underlying disease with a number of equivalent indicators, but as a network of symptoms that have direct causal influence on each other: insomnia can cause fatigue which then triggers concentration and psychomotor problems. This approach offers new opportunities for constructing an empirically based classification system and has broad implications for future research. (shrink)

We review the current situation in the philosophy of time, partly to investigate Michael Dummett’s complaint that the philosophy of physics has become too specialized and technical to be able to communicate with mainstream philosophy. We conclude that the situation in this case is different: there is no special difficulty of intelligibility---the obstacle for communication between science and philosophy here is rather that what physics, or science in general, tells us is prima facie in conflict with common sense and intuition. We argue that this difficulty is indeed prima facie: on closer inspection it appears that the scientific B-theory may explain our intuition better than the A-theory, even though the latter at first sight seems to completely mirror our direct experience. The present essay examines the conflicting ontological assumptions that one can find behind the word dao in the texts of the Laozi and Zhuangzi and argues that the relative indifference to these texts toward whether or not dao has an ontic reality should not be considered a flaw of early Daoism. Rather, the historical process by which the term dao collects various possible ontological implications can be thought of as a philosophical stance in its own right. That is, if the (...) terms which one is obliged to use in discussing the immaterial necessarily hide, at least as much as they explain, the nature of Being, then it is a reasonable response to decline to ground one’s ethics in an ontology, and that while the resulting philosophy may not qualify as a fully-adumbrated system, this does not diminish its potential usefulness. Does a flourishing life involve pursuing passionate attachments? Can we choose what these passionate attachments will be? This book offers an original theory of how we can actively cultivate our passionate attachments. The author argues that not only do we have reason to view passionate attachments as susceptible to growth, change, and improvement, but we should view these entities as amenable to self-cultivation. He uses Pierre Hadot's and Michel Foucault's accounts of Hellenistic self-cultivation as vital conceptual tools to formulate a (...) theory of cultivating our passionate attachments. First, their accounts offer the conceptual resources for a philosophical theory of how we can cultivate our passionate attachments. Second, the exercises of self-cultivation they focus on allow us to outline a practical method though which we can cultivate our passionate character. Doing this brings out a significantly new dimension to the role of the passionate attachments in the flourishing life and offers theoretical and practical accounts of how we can cultivate them based on the Hellenistic conception of self-directed character change. Cultivating Our Passionate Attachments will be of interest to advanced students and scholars working in virtue ethics, moral philosophy, and ancient philosophy. (shrink)

Analysing how news media portray A.I. reveals what interpretative frameworks around the technology circulate in public discourses. This allows for critical reflections on the making of meaning in prevalent narratives about A.I. and its impact. While research on the public perception of datafication and automation is growing, only a few studies investigate news framing practices. The present study connects to this nascent research area by charting A.I. news frames in four internationally renowned media outlets: The New York Times, The Guardian, (...) Wired, and Gizmodo. The main goals are to identify dominant emphasis frames in AI news reporting over the past decade, to explore whether certain A.I. frames are associated with specific data risks, and what journalists and experts contribute to the media discourse. An automated content analysis serves for inductive frame detection, identification of risk references, and network analysis of news writers. The results show how A.I.’s ubiquity emerged rapidly in the mid-2010s, and that the news discourse became more critical over time. It is further argued that A.I. news reporting is an important factor in building critical data literacy among lay audiences. (shrink)

Interview with Richard Rorty, April 1997, Amsterdam. Occasion for the interview was Rorty being the occupant of the Spinoza Chair in 1997. The interview is mostly about Rorty's paper 'The Intellectuals and the Poor', in which he criticises the politics of left-wing academics.

In The Choice Theory of Contracts, Hanoch Dagan and Michael Heller state that by arguing “that autonomy matters centrally to contract,” Contract as Promise makes an “enduring contribution... but [its] specific arguments faltered because [they] missed the role of diverse contract types and because [it] grounded contractual freedom in a flawed rights-based view.... We can now say all rights-based arguments for contractual autonomy have failed.” The authors conclude that their proposed choice theory “approach returns analysis to the mainstream of twentieth-century (...) liberalism – a tradition concerned with enhancing self-determination that is mostly absent in contract theory today.” Perhaps the signal flaw in Contract as Promise they sought to address was the homogenization of all contract types under a single paradigm. In this Article, I defend the promise principle as the appropriate paradigm for the regime of contract law. Along the way I defend the Kantian account of this subject, while acknowledging that state enforcement necessarily introduces elements — both normative and institutional — for which that paradigm fails adequately to account. Of particular interest and validity is Dagan and Heller’s discussion of contract types, to which the law has always and inevitably recurred. They show how this apparent constraint on contractual freedom actually enhances freedom to contract. I discuss what I have learned from their discussion: that choice like languages, is “lumpy,” so that realistically choices must be made between and framed within available types, off the rack, as it were, and not bespoke on each occasion. I do ask as well how these types come into being mutate, and can be deliberately adapted to changing circumstances. (shrink)

His position is interesting and seems plausible with regard to “default” motion detection and aspects of colour constancy which he addresses. However, his claim is not convincing with regard to object recognition. [Shepard].

This book is a personal history and apology, written by one of this century's most distinguished small mammal ecologists, for a life in science spent working on problems for which no final dramatic conclusion was reached. Included along the way are some important anecdotes and history about Charles Elton and the pioneering work at the Bureau of Animal Population at Oxford University, from which most of modern population ecology has grown, and insigts on the philosophy and practice of science.

This very short introduction will first outline how ontological investigations and questions of practice go together. The second section will bring in the next pole of this entire book, history of mathematics. How do ontology, practice, and history go together? Is this a forced marriage or one born in true love? That is, do these three belong together in some very basic way? One chapter in the section argues that the philosophy of mathematical practice intersects with the history of mathematics (...) essentially. If the first section of this introduction is persuasive that will also show that the history of mathematics intersects with ontological questions as well, specifically, that historical questions are very much about the ontological commitments of past mathematicians. The last section will take up what might seem a very different theme, namely, how these things matter to mathematics education. This section is connected closely to the second section since mathematics education has taken an interest in the role of history of mathematics in mathematics education, and much insight can be gained by seeing the issues in relation to the ontology-practice-history triad. The question of education is also important since teachers must consider what it is exactly that they are teaching, or, to adapt the title of Reuben Hersh’s well-known book, “What is mathematics really about?” And the “aboutness” of mathematics is really the ontological question.
